Previously, the court of first instance partially granted the claim of Aitbek Amangeldy, the brother of the deceased. According to the ruling, the convicted individual was ordered to pay 6,877,672 tenge as compensation for expenses related to the criminal case, as well as 10 million tenge for moral damages. However, the plaintiff deemed this amount insufficient and filed an appeal, demanding that the compensation be increased to an impressive 1.5 billion tenge.
Case materials indicate that Kuandyk Bishimbaev was found guilty of murdering Saltanat Nukenova. The brother of the deceased stated that the tragedy inflicted severe moral trauma, undermined his health, and rendered him incapable of working. Meanwhile, Saltanat's parents withdrew their claims against the convicted individual.
The court of first instance acknowledged that the death of a close relative inevitably dealt a heavy blow to the plaintiff's moral state and violated his personal non-property rights. However, guided by principles of reasonableness and fairness, it limited itself to partially granting the claim.
Today, the appellate panel for civil cases in Astana upheld the decision of the first instance court. The plaintiff's appeal was dismissed, and the court rulings have come into legal force.
It is worth recalling that Kuandyk Bishimbaev was sentenced in May of this year to 24 years of imprisonment in a high-security colony for the brutal murder and torture of Saltanat Nukenova.
