The Ministry of Finance will now be able to address cases of violations committed by quasi-state companies during the procurement of goods, works, and services.
Previously, the Code of Administrative Offenses did not include a provision allowing for their accountability, but this gap was closed following recommendations from the Audit Chamber.
Amendments to the legislation were made on January 10, 2025, enabling the Ministry of Finance to respond swiftly to violations, conduct investigations, and penalize those responsible.
It is anticipated that the risk of administrative liability will compel quasi-state companies to adhere more closely to procurement rules, while identified violations will help uncover systemic issues and improve procurement processes.
President Kassym-Jomart Tokayev instructed a review of the public procurement system and the procurement processes in the quasi-public sector back in 2022, making the control process more transparent and stringent.
